COVID-19 Pandemic: DKI Jakarta Reimposes Strict Large-Scale Social Restriction by 14 September 2020

In response to the continuous spike in COVID-19 cases during the implementation of the transition phase of Large-Scale Social Restriction/Pembatasan Sosial Berskala Besar (“PSBB”) in the past several weeks, The DKI Jakarta’s Governor, Anies Baswedan has decided to reimpose stricter PSBB measure by 14 September 2020 until 28 September 2020 (“Strict PSBB”). However, please note that such period may be further extended for 2 weeks period of each time.

Legal Frameworks: Our below executive summary refers to the DKI Jakarta Governor Regulation No. 88 of 2020 on the Amendment to the Regulation No. 33 of 2020 on the Implementation of Large-Scale Social Restrictions in the Management of Corona Virus Disease 2019 (COVID-19) within the DKI Jakarta area (“Governor Regulation 88/2020”).

Main Keys on the Implementation of Strict PSBB within DKI Jakarta: We have managed to provide you the following main keys regarding the implementation of Strict PSBB within DKI Jakarta Area.

Restriction in Workspace: We note that 25% of an employer’s workforce will be permitted to be present in the workplace provided that the Work From Home (“WFH”) arrangement would not be possible (Art. 9 (2) of Governor Regulation 88/2020). Such restriction is more relaxed compared to the earlier PSBB that happened in April-June 2020 that required all non-exempt sectors to fully implement full WFH policy.

Restriction for Markets and Shopping Centers: Traditional markets and shopping centers are permitted to operate at 50% of visitor capacity. In this respect, all restaurants and cafes will only be allowed to provide takeaway and delivery orders (Art. 10 (3) of Governor Regulation 88/2020).

Restriction on Public Transportations Operation: Any public transportations operation hours will be subsided, and the passenger capacity is limited to a maximum of 50%. Additionally, the odd-even license plate traffic policy is temporarily waived during the Strict PSBB imposition (Art. 18 (7) of Governor Regulation 88/2020).

Activities within House of Worship: Places of worship in residential areas and housing complexes are allowed to remain open at 50% capacity. However, houses of worship located in COVID-19 red zones will be required to close (Art. 11 (1) of Governor Regulation 88/2020).
